
With some confusion, Washington still allows the use of delta-8. In 2021, the state's Liquor and Cannabis Board issued a policy statement calling for the sale and production of delta-8 products to be outlawed. Later in September 2019 a clarification was released clarifying that delta-8 items are in fact forbidden with no exceptions.
Although, Delta-8 products aren't formally prohibited, as the policy announcements are typically neither enforceable or supported by official law. Several legislative initiatives, like Senate Bill 5983, that sought to outlaw delta-8 in 2022, fell short.
