According to the New Mexico Hemp Manufacturing Act, which legalized hemp and hemp compounds, including delta-8, delta-8 is not classified as a restricted drug under state law. As a result, using, possessing, selling, distributing, purchasing, and producing hemp-derived delta-8 is legal and unaffected by penalties or punishment. The New Mexico Cannabis Regulation Act also legalized recreational marijuana for adults aged 21 and up, making marijuana-derived delta-8 lawful in the state.
